Your use of this website and any service contained within constitutes acceptance of these Terms & Conditions.

These Terms and Conditions apply to all transactions. Please read them carefully. They do not affect your statutory rights. We may change these terms and conditions at any time. Any changes will take effect on the date they are posted By using and ordering online, by telephone or other mail order you are in agreement and accept our terms and conditions, If you do not understand or accept any of our terms and conditions you should cancel your order or you may contact us at any time for clarification before you place a order

Customer Information

You should always check that the contact information you provide is correct before creating a customer account or proceeding to payment. You are responsible for maintaining your own username and password, where required to access your customer account. You should ensure that you store your username and password securely and that the details required to access your customer account are not provided to another party. As a customer you are responsible for your customer account and actions taken within it. If you are aware or suspect that your customer account username and password or other details have become known to a third party, you should inform us immediately.

Our website is only intended for use by adults.

Privacy

Epoca Car takes your privacy seriously. We comply with the Italian laws regulating the individual's Right to Privacy (Law number 675 of 1996). For further details please see our Privacy Policy.

Product Pricing and Title

We make every effort to ensure that the pricing displayed on our website is correct. However, if an error in the pricing of a product is found we reserve the right to either cancel your order or contact you to arrange payment of any extra sum due or refund any over-payment made by you (as applicable). The processing of an order can be cancelled or corrected by us at anytime up to the shipment of that order and any related items.

We reserve the right to alter all product pricing without notice. Title in any products ordered from us does not pass to you, the purchaser until we have received and processed a valid payment, and that payment has been made into our own ban or paypal account and your order has been shipped and delivered.

Your Order

When you place an order you will automatically receive a contact email from us to confirm your order. Product items not included within the dispatch email are not included in the order and contract between you and us. We reserve the right to delay or refuse orders where a transaction contains incomplete details or details that cannot be verified or where fraud is suspected. If we are unable to reasonably ascertain these details or resolve these issues a full refund will be made by paypal or by bank transfer.

Prices and Payment

All prices and charges on this site are in Euros. The total cost of your order will be the price of the products you have ordered, plus any applicable delivery charges. All these will be set out you clearly. Prices, offers and products are subject to availability and may change before (but not after) we accept your order. If something becomes unavailable we may offer you an alternative in which case the price may vary, we will inform you of any price changes prior to processing your order. We try very hard to ensure that all information on this site is accurate. However, just occasionally, an error can occur If we discover an error in the price or description of a product you have ordered, we will tell you and ask you whether you wish to continue with your order or cancel it. For payment we accept Master card, Visa, American Express, paypal or bank transfer. Payment is deducted when we process your order but we do reserve the right to refuse any form of payment we feel is not secure.

VAT - EEC orders

All prices are included vat at the current rate.

EEC - VAT Exempt orders

VAT is charged on all sales to EEC countries however companies registered in the eec can have the vat removed from the transaction ( zero rated export ) to qualify for a vat zero rated transaction you must send to us a copy of your companies vat certificate for us to keep on file. Please be advised that we are only able to deliver to the name and address of the company which is on the vat certificate.

Shipping and Delays

All orders received by us are shipped subject to availability. We reserve the right to ship products at a later date (up to 28 days after purchase) where the product ordered is not in stock at the time of purchase. In this situation you may be contacted and offered a full refund instead of delivery of the product. We cannot be held responsible for disruption to shipping caused by industrial disputes or action outside our direct control. If such disruption occurs you will be offered delivery via an alternative delivery or fulfilment company or a full refund.

Occasionally, delivery of your order may be delayed or postponed. We will, of course make every effort to keep you informed and discuss revised delivery timescales, we do accept no liability whatsoever for delayed or lost orders. If you are ordering a product from outside Italy the recipient of the product is responsible for all customs duties or tariffs incurred in the country to which the products are shipped. Furthermore your order may be subject to delay or be opened and searched by local customs authorities when entering the destination country. Please note we are unable to provide specific advice on customs duties or tariffs.

Delivery times are only an estimate and cannot be guaranteed.

Export Sales

All export sales are final and not returnable unless defective or incorrectly supplied by this company, however should a return be accepted you are responsible for paying any postage and all costom fees or shipping costs incurred when returning the product and its safe arrival at our works.

Availability

From time to time, products may not be in stock. If a product is out of stock, we will contact you and advise you of the delivery date if possible before processing your order, alternatively we may part ship the balance of your order with the rest to follow.

Cancelling Orders

Should you want to cancel your order prior to dispatch you must confirm this by email and by telephone however due to the high volume of parcels we dispatch every day it may not always be possible to catch and cancel your order. Should your order still be dispatched and delivered it must be treated as a return and the appropriate procedures followed.

Cancellation Rights, Returns and Refunds

Under the Consumer Protection (Distance Selling) you have a right to cancel your purchase. However, to exercise this right you must notify us in writing, (email or letter) within 10 working days from the day after you receive your goods. As stated above notification of cancellation must be in writing, a telephone call is not a valid cancellation. No right of cancellation, refund or return exists under the Consumer Protection (Distance Selling) once you have used, unless the product is defective and you are returning it for this reason. Goods that are sealed or shrink-wrapped and this is removed can only be returned if they are defective.

No right of cancellation exists for personalised goods unless defective or goods that have been specially ordered for you. Please observe the following procedure for all returns to us: Please complete our returns form and send it together with the part (s) you are returning If you are returning your product because it is defective, please state the defect or defects. Repackage the product in its original packaging, including any accessories, brochures, manuals, guarantees or warranties that came with the product. Unfortunately we will be unable to issue a refund where the product is in an incomplete state. If the original packaging surrounding the product has been damaged or destroyed we will only issue a refund if the product is being returned due to a defect. If the original packaging of a defective product has been damaged or destroyed you should ensure that the returned product is adequately packed for shipment back to us. You are responsible for paying any postage or shipping costs incurred when returning the product and its safe arrival at our works. We recommend that all returns be sent by registered post, so that a record of the return is available for you. We will not issue refunds for any items damaged, lost or stolen in transit to us. Where a return is damaged, lost or stolen in transit to us, you should claim compensation from the company that shipped the return. If you fail to return a product to us, we may make arrangements to have the product collected from you. The cost of this collection will be charged to you. Unused products may be returned promptly by customers within 14 days of receipt to our address listed in the contact details of our website, We accept no returns after 14 days of receipt of goods Subject to the above, we will refund the purchase price of a returned product within thirty days of reciept, a restocking charge of 15% of the original purchase price will be applied for all returned parts that were correctly supplied. We will also refund the cost of standard or recorded postage incurred returning a product, if incorrectly sent by us or where the product has been returned due to a defect. Please note that we will not refund any courier, overnight or express element of any delivery or postage charge, including Poste Italiane.

Customer Complaints

We endeavour to respond to all customer complaints or queries within five working days.

Delivery Charges

Delivery charge is subject to change depending on weight and volume of parcel plus may vary depending on location. Please ask us them previously.

Alternative Delivery Address

Please note we are only able to deliver to the billing address of the paypal form holder unless prior arrangements have been made and authorised by us or you are a established customer, However alternative delivery address's are entirely at our discretion.

How we Deliver

All products are delivered either by courier or by post, depending on their size and value. All orders will need to be signed for on delivery, please ensure that a responsible person is available to inspect and sign for the parts you have ordered. Delivery times are only a estimate and cannot be guaranteed.

Delivery times

Our dispatch team do try and send all orders where possible the same day but this may be affected during peak periods or other factors such as stock control or constraints by our couriers Delivery times are calculated in working days - i.e. Monday to Friday inclusive.

IMPORTANT: We do everything we can to meet delivery times and our customers expectations however, occasionally delivery times may be affected by factors beyond our control and therefore they cannot be guaranteed. Delivery times are only a estimate and cannot be guaranteed.

Delivery times EEC

Small packages with a packed weight of under 2 kilos are normally sent by express mail and should be delivered to most areas of Europe within 2 to 5 business days, packages over 2 kilos packed weight are normally dispatched by European road service and delivery time is approximately 3 to 5 business days from the time of dispatch.

Missing and or damaged Goods

If the box that contains your parts arrives by courier damaged you should refuse the package and notify us immediately You must check your order upon receipt and notify us of any shortages or damaged parts within 24 hours of your order being delivered, claims received after this period will not be accepted Incorrect or damaged Parts returned for exchange, You will be charged pending safe return, inspection and acceptance of the incorrect parts, this you hereby authorise

 

Entire Terms & Conditions

These Terms & Conditions set out the entire agreement and understanding between you and Epoca Car Srl. We reserve the right to change these Terms & Conditions at any time, without giving notice to you. These terms and conditions and all transactions relating to this website are governed by Italian law and are subject to the jurisdiction of the Tribunale di Venezia.
